NEW ORLEANS — The Fifth Circuit found a federal court in Louisiana erred in granting the motion to suppress evidence filed by a man who was under surveillance at his apartment as part of a drug trafficking investigation, and later stopped on the road for a window tint infraction. During that stop, he admitted to having drugs at his apartment and a storage facility, but the court says the window tint infraction did not justify the stop. The appellate court says that reasonable suspicion of drug trafficking could have been an independent justification.
