DENVER — The 10th Circuit ruled that requiring trans inmates to be housed with inmates who do not share their gender identity plausibly constitutes a violation of the Constitution’s equal protection clause. The trans woman who brought the suit will also be able to pursue her Fourth and 14th Amendment claims over a policy requiring male deputies to strip-search trans women without supervision. Most officials she sued enjoy qualified immunity, though, as the officers did not violate a clearly established constitutional right.
