LAS VEGAS — The Nevada Supreme Court reversed a ruling in favor of Caterpillar in a widow’s wrongful death action filed on the theory that a defectively designed mine loader rolled over and killed her husband. A report found the husband did not follow safety protocols, but the widow argued the machine should have been outfitted with an automatic brake regardless of the protocols, and she was not given a chance to cross-examine the report’s author. Without the report, a jury may have reached a different verdict.
