9th Circuit upheld Washington cap-and-trade scheme

SEATTLE — The Ninth Circuit upheld a Washington law allowing the state to give emissions allowances to electric utilities at no cost, but charges non-utility power plant operators for allowances. The appellate panel ruled this regulatory scheme does not violate the dormant commerce clause or the equal protection clause, as the requirement to either pay for allowances or reduce their carbon emissions does not constitute a substantial burden on interstate commerce and serves legitimate government interests.
