DANVILLE, Va. — A federal court in Virginia will allow a Black medical patient’s claims of willful and wanton misconduct to proceed against his physician, who he had joined for a telehealth visit to address the patient’s major depressive disorder with psychotic features. The patient asked the doctor to remove a Confederate flag visible in the corner of her office, but she accused him of hallucinating and falsely wrote in her notes that she “assured him that I didn’t have a confederate flag on my wall and that I agreed that black lives matter, all lives matter.” But the patient took a screenshot plainly showing the flag on his screen.
