Khazar Momeni testifies Bob Lee was not sober and ‘all over the place’ in days preceding his killing

SAN FRANCISCO (CN) — Khazar Momeni, on cross examination Tuesday during her third day of testimony in her brother’s murder trial, said that Cash App founder Bob Lee was intoxicated and aggressive in the days before his death.

Lee was found stabbed in San Francisco’s Rincon Hill neighborhood near the Bay Bridge in the early morning hours of April 4, 2023. Prosecutors say that Khazar’s brother Nima stabbed Lee in a rage, because he believed Lee was giving his sister drugs.

Khazar Momeni testified that on March 31, Lee came to her apartment around 5 a.m. and did drugs. She believed he was up all night on a bender.

“Cocaine and ketamine. He was definitely under the influence,” she said, noting that he was also drinking alcohol.

Saam Zangeneh, Nima Momeni’s defense attorney, asked Khazar Momeni to describe Lee’s behavior that night.

“He was all over the place. Aggressive,” she replied.

Eventually, Lee left and went to a party at Twitter headquarters. The two didn’t speak again until April 3 when Lee texted Momeni. At that time, Momeni was hanging out at the residence of Jeremy Boivin, a drug dealer whom she said Lee introduced to her. 

“Coming with a tank. Gonna cost you a blowjob though,” read a text message that Lee sent to Momeni on the afternoon of April 3. Momeni said that she never had a sexual relationship with Lee, but that he was sometimes inappropriate with her.

Under questioning from Zangeneh, Momeni said she understood “tank” to mean nitrous oxide, commonly known as whippets. She said Lee showed up soon after, as well as Lee’s friend Bo Mohazzabi. 

Momeni said Lee was intoxicated that afternoon as well, and that they all drank and did drugs together.

Momeni testified that Mohazzabi began to make her uncomfortable, and she asked Boivin to tell Mohazzabi to leave. He and Lee did, but Lee texted Momeni an angry message shortly after leaving.

“Get your ass in my Uber, or never speak to me again,” Lee wrote. Momeni refused, and Lee and Mohazzabi left.

After Lee and Mohazzabi left, Momeni said Boivin sexually assaulted her after giving her a date rape drug, revelations that she first revealed during her testimony yesterday.

When she woke up from the assault and called her parents, her brother Nima and her husband came to pick her up at Bovin’s residence.

Boivin helped her to the lobby of his residence; elevator footage showed Momeni wearing a different outfit than the one she showed up in and looking panicked. At one point she leaned against Boivin to stop from falling over and was holding her hand over her mouth.

Boivin took her out to Nima and her husband. She said Nima was calm and cool.

She said she told her brother in the car that Boivin had given her GHB and touched her without her consent.

“At any point in that conversation, did you mention Bob Lee?” Zangeneh asked. 

“No,” Momeni replied.

Zangeneh then asked Momeni if she ever told her brother that Lee had given her drugs or sexually assaulted her.

“No,” Momeni answered again.

Later in the night, Boivin and Nima Momeni met face to face at Khazar Momeni’s apartment when Boivin came to pick up drugs he had left there. Khazar Momeni again said her brother remained calm, and that she never mentioned Bob Lee at all in relation to what happened to her.

In the early morning hours of April 3, Lee showed up to Khazar Momeni’s apartment. Momeni said her brother and Lee were cordial and drank with each other.

“Did you ever have any inclination that there was any bad blood between your brother and Bob Lee?” Zangeneh asked.

“They liked each other,” Momeni answered, before Zangeneh showed elevator footage that night of Nima Momeni and Lee leaving Khazar’s Millennium Tower residence. In the footage, Momeni briefly wraps his arms around Lee.

The defense’s line of question seemed to be hinting that Nima Momeni lacked a motive for killing Lee. Over a week of testimony, the prosecution has yet to produce concrete evidence that Nima Momeni was upset at Lee or thought he drugged or sexually assaulted his sister, as they asserted in opening arguments.

Nima Momeni’s defense team admitted during opening arguments last week that he stabbed Lee, but said that he did it in self defense after Lee attacked him in a drug-induced rage.

Testimony continues Wednesday. Khazar Momeni remains on the stand.
