SAN FRANCISCO (CN) — Khazar Momeni, the sister of the man accused of stabbing and killing Cash App founder Bob Lee in April 2023, testified Monday that a drug dealer friend of Lee sexually assaulted her the day before the murder.
Momeni said that on the afternoon before Lee’s death, she was hanging out with Lee and some friends at the residence of Jeremy Boivin, who she referred to as a drug dealer. She said she had met Boivin through Lee that morning.
“Everyone was partying. There was a bowl of cocaine there, there was a tank of nitrous,” and people were talking and having drinks, she said. Momeni said she took a dose of LSD at the gathering.
Momeni testified that Lee’s friend, Bo Mohazzabi, began to make her uncomfortable because he was staring and smirking at her. She said Boivin asked Lee to leave with Mohazzabi, leaving Momeni and one of her girlfriends alone with Boivin, who then slipped both of them GHB in drinks.
GHB — gamma hydroxybutyrate — is a party drug that causes relaxation in those that use it, and can also cause users to black out. It’s known as a “date rape” drug, because it is hard to detect if slipped into a drink at a party.
“He just kept bringing the shots and I guess I feel silly that I kept taking them,” Momeni said. “He would say, ‘Let’s take another shot of GHB.’”
Momeni said she didn’t know the effects of GHB and soon passed out. She called GHB “really scary.”
“You can be out for hours and not know how long you were out,” Momeni said.
She said she remembered waking up face down with her friend in Boivin’s bed. Boivin soon walked in the room wearing a pair of small red shorts, Momeni said. She said she was sexually assaulted, but could not be sure if she was raped because she did not know what happened while she was passed out.
“I remember waking up twice. One time he pulled down my pants and slapped my ass,” she said. The other time she woke up, Momeni said Boivin reached for her bottom again, this time squeezing it.
Eventually, Momeni woke up. “I was scared, crying. Crying like I never have before,” Momeni said, telling the court that Boivin would not let her grab her phone. Eventually she did, calling her brother Nima, who picked her up.
“He was very calm and collected. He just wanted to know what happened. He asked if anyone sexually assaulted me,” she said of her brother’s demeanor.
“I told him exactly what happened. Boivin slapped me and pulled down my pants and grabbed my ass while I couldn’t move.”
Khazar Momeni said that eventually Nima called Lee and asked what happened at Boivin’s residence. During opening arguments, prosecutors described that call as an “interrogation,” arguing that Nima Momeni murdered Lee because he believed Lee drugged his sister.
Mohazzabi, testifying last week, was present when Nima Momeni called Lee. He said he heard the conversation over speaker phone and said Nima Momeni was hostile.
Khazar Momeni said the call was cordial, however.
“He was just asking Bob what Jeremy Boivin had given me,” Momeni said of the phone call.
Later in her testimony, Khazar Momeni said she never told her brother that Lee had assaulted or drugged her, and that her brother eventually confronted Boivin at Khazar’s apartment after Boivin came over to pick up drugs he had left there the previous morning. She said they argued, and Boivin wanted to fight Nima Momeni, but she said her brother remained calm.
Later, in the early morning hours of April 4, Lee came over to Khazar Momeni’s Millenium Tower residence.
“I wanted to see him again,” Khazar Momeni said of Lee. She said she doesn’t remember if she told Lee that Boivin assaulted her.
She said Nima Momeni and Lee hung out that night. Nima Momeni asked Lee what kind of drugs Boivin had given Khazar, and Nima and Lee made plans to go to a strip club, Khazar Momeni said.
“They liked each other. They were drinking together and talking,” she testified.
Lee would be seen later that morning leaving with Nima Momeni, and was found stabbed at a location near the Bay Bridge around 3 a.m.
The defense, in its opening arguments, said that Nima Momeni did stab Lee, but that it was in self defense and that Momeni had no motive for the murder. They said there was no evidence that Momeni believed Lee had sexually assaulted Khazar Momeni or that he was angry with Lee, but argued that Lee, on a multiday drug bender, was the aggressor.
Khazar Momeni will continue her testimony Tuesday.
