PHILADELPHIA — The Third Circuit asked a Delaware federal court to explain itself after a ruling in this dispute over 10 allegedly false advertisements in a marketing campaign for diagnostic tests for kidney transplant patients. The jury found that nine of the challenged ads were literally, unambiguously false, and when the accused advertiser argued the evidence was insufficient to support this finding, the lower court reviewed only one ad. It is now ordered to address the rest of the allegedly false advertisements.
