Constable acquitted

SAN ANTONIO — A Texas appeals court threw out a tampering with evidence conviction against former Bexar County Constable Michelle Barrientes, ruling that the prosecution did not sufficiently prove that she concealed or altered payment documents related to an investigation into her practice of charging residents for security when reserving park pavilions for more than 50 people. Failing to produce accurate records usually leads to a motion to compel or to sanctions, not to a criminal indictment, the appeals court said, acquitting her of the charges.
